Terms of Service

These Terms of Service ("Terms") govern your access to and use of the MyKidRoute family coordination platform, including our website at mykidroute.com, our mobile applications, and related services (collectively, the "Services"), provided by MyKidRoute LLC ("MyKidRoute," "we," "us," or "our"). By creating an account or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Who may use the Services

You must be at least 18 years old and a parent, legal guardian, or authorized adult to create an account. By using the Services, you represent that you have the legal authority to provide information about any child you add to your account and to arrange transportation and pickups for that child.

2. What MyKidRoute is

MyKidRoute is a coordination platform that connects families with drivers, coaches, and schools to arrange and verify school dismissal, pickups, carpools, activities, and rides. MyKidRoute helps families coordinate these arrangements; the drivers and coaches who provide services through the platform are independent providers and are not employees of MyKidRoute.

3. Your account

You are responsible for the accuracy of the information you provide, for keeping your login credentials secure, and for all activity that occurs under your account. Notify us promptly of any unauthorized use. Keep your child's information, approved pickup contacts, and pickup locations accurate and up to date, since the Services rely on that information.

4. Verification and background checks

Drivers and coaches are subject to identity verification and background checks conducted by a third-party screening provider before they may offer services, and eligibility may be re-checked over time. Background checks have inherent limitations and do not guarantee the future conduct of any person. You are responsible for using your own judgment about the arrangements you make through the Services.

5. Rides, pickups, and availability

The Services help you request and coordinate rides and pickups but do not guarantee that a driver will be available for any particular request, or that any ride or pickup will occur at a specific time. Estimated times are approximate. You are responsible for confirming that your child has been picked up or dropped off through the verification features provided.

6. Payments, fees, and cancellations

Prices, fees, and any applicable cancellation charges are shown before you confirm a booking. Payments are processed through a third-party payment processor. By booking, you authorize us and our payment processor to charge the payment method on file for the amounts shown, including any cancellation fees that apply under the cancellation terms presented at booking. Payouts to drivers and coaches are made through the same processor.

The safety of children is our shared priority, but you remain responsible for decisions about your child's transportation and for supervising your account. Use the verification features at every handoff. If you ever believe a child is in danger, contact local emergency services immediately.

9. Disclaimers

The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.

10. Limitation of liability

To the fullest extent permitted by law, MyKidRoute and its officers, members, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising out of or related to your use of the Services. Our total liability for any claim relating to the Services will not exceed the greater of the amount you paid us in the twelve months before the claim or one hundred dollars, except where such a limitation is not permitted by law.

You agree to indemnify and hold harmless MyKidRoute from any claims, damages, liabilities, and expenses arising out of your use of the Services, your violation of these Terms, or your violation of any rights of another person.

You may stop using the Services at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the safety and integrity of the platform. Provisions that by their nature should survive termination will survive.

13. Dispute resolution and governing law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules, and the Services are operated from Massachusetts. Any dispute relating to the Services will be resolved as described here, and you agree to attempt to resolve disputes with us informally before pursuing formal action.

14. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the effective date above and, where appropriate, provide additional notice. Your continued use of the Services after changes take effect means you accept the updated Terms.
